A commendable law is being passed by the Supreme Court on Thursday, where the Supreme Court made it clear that women either married or unmarried can now legally abort before their foetus grows 24 week old. The supreme court made the landmark decision and said that now the abortion of child by women’s consent is legal either be a married woman or unmarried, even if the relationship was with her consent the abortion is now the legal thing across the country.
Under the Medical Termination of Pregnancy act, the apex court made it clear that women either be married or unmarried can now legally abort their child before turning it to 24 weeks. By talking bout the pregnancy and abortion the top court also made sure on the topic of Marital rape, the sexual assault by husband which can eventually called as rape takes the form of marital rapes. While further talking about the abortion Supreme court said “Unsafe abortions are preventable.

“Unsafe abortions are preventable. Our understanding of mental health has to be considered in common parlance. Account must be taken of a pregnant woman’s environment.”
“It’s ultimately the prerogative of each woman to decide as per her material circumstances. Various economical, cultural or social factors play a part… The artificial distinction between married and unmarried women cannot be sustained. Women must have the autonomy to have free exercise of these rights,” said the Justice.
This decision is being made by Supreme court after a 25 year old unmarried woman approached the Supreme Court as she was 23 weeks pregnant after being in a 5 days old relationship with her partner, she approached Supreme court when her partner refused to marry her and the relation with her partner was with her consent.
Then the Chief Justice observed that the pregnancy of unmarried women with her consent was not covered in the Medical Termination of Pregnancy rule 2003.
